Four Lakes Computing places a lot of trust in Cx customers to protect the
secrecy of Cx. Intentional (or more likely) negligent disclosure of the
Cx algorithms (in any form) can, however, be very harmful to Four Lakes
Computing. This is a fairly obvious statement, but it is important to
understand the license agreement so that you know exactly what rights are
granted and how you may be held liable in the case of harm to Four Lakes
Computing.
It is suggested that you keep all Cx source code in a protected place
when it is not being used to create object code.
License for Cx 2.01 Data Compression Toolkit
---------------------------------------------------------------------
In this agreement, UNDERSIGNED shall mean any person or
organization who has legally obtained Cx 2.01 through
purchase, through the evaluation package or through a
pre-release beta package. In this agreement, APPLICATION
shall mean any end user computer program, distinct from
computer libraries and computer development tools. In this
agreement Cx refers exclusively to Cx version 2.01.
PROPRIETARY INFORMATION shall mean all technical information
disclosed by Eugene Nelson and Four Lakes Computing to
UNDERSIGNED, which is not common general knowledge and
shall remain PROPRIETARY INFORMATION as long as it does
not become general knowledge except by disclosure by UNDERSIGNED
in contravention of the obligations of this agreement.
UNDERSIGNED is granted the right to use the object code and
test programs contained in the evaluation and pre-release beta
packages for evaluation purposes only. No other rights are
granted to use or distribute the Cx object, source code or test
programs in the evaluation and pre-release beta packages. Any
other rights granted in this agreement apply exclusively to
purchased copies of Cx object and source code.
UNDERSIGNED is granted the right to distribute APPLICATIONS
developed by UNDERSIGNED only which use the Cx object code or Cx
source code. UNDERSIGNED is granted the right to distribute the
Cx dynamic link libraries for use with APPLICATIONS developed by
UNDERSIGNED only.
UNDERSIGNED is granted the right to distribute any computer
machine language derivatives of the Cx source code for use
with APPLICATIONS developed by UNDERSIGNED only, provided
these derivatives contain the following copyright notice:
'Cx 2.01 Copyright (c) 1987-1994 Eugene Nelson, Four Lakes Computing.'
UNDERSIGNED agrees not to remove or obscure any copyright
notices contained in Cx object code, Cx source code, computer
language derivatives of Cx source code, or APPLICATIONS which
use Cx.
UNDERSIGNED agrees to hold in strictest confidence all PROPRIETARY
INFORMATION received from Eugene Nelson, Four Lakes Computing
and shall not disclose any such information or know-how to any
third party or parties without the prior written consent of Eugene
Nelson, Four Lakes Computing.
UNDERSIGNED agrees to exercise all necessary precautions to
safeguard the secrecy of all Cx object code, Cx source code,
and all PROPRIETARY INFORMATION disclosed by Eugene Nelson,
Four Lakes Computing.
UNDERSIGNED agrees that Cx may not be used to decompress or
otherwise reveal data that was not created using UNDERSIGNED's
APPLICATIONS.
Eugene Nelson and Four Lakes Computing hereby disclaim all
liability, whether express or implied, regarding merchantability
of Cx, or its fitness for any particular purpose. In no
circumstances will Eugene Nelson's or Four Lakes Computing's
liability exceed the purchase price of Cx.
UNDERSIGNED agrees that failure to abide by this agreement whether
intentional, through negligence or in any other way by UNDERSIGNED,
or agents or contractors of UNDERSIGNED shall result in continuous
and irreparable harm to Eugene Nelson, Four Lakes Computing, for
which UNDERSIGNED can and will be held liable, and will result in
the immediate and permanent annulment of any rights granted to
UNDERSIGNED in this agreement, and will require injunctive relief.
This agreement will be governed and interpreted by the laws
of the United States.
